NDAA 2027's Quiet Revolution: Congress Is Beginning to Build the Rules for a Post-China Critical Minerals Economy

America is spending billions to rebuild its rare earth supply chain—from mine to magnet. Under the Trump administration, federal agencies have accelerated investments in domestic mining, separation, metals, alloys, and magnet manufacturing in an effort to reduce dependence on China. But rebuilding factories is only half the challenge. As Defense Department procurement rules tighten under DFARS and Congress considers sweeping reforms in the Fiscal Year 2027 National Defense Authorization Act (NDAA (opens in a new tab)), the next competitive advantage may not be another mine or processing plant—it may be the ability to digitally prove where every strategic material came from and every step it took before reaching the Pentagon. One important caveat: none of these NDAA provisions have become law.

The version discussed here is the House Armed Services Committee's Chairman's Mark. While the committee approved the legislation, it must still pass the full House, be reconciled with a Senate version, and ultimately be signed by the President. Senate consideration has already encountered procedural roadblocks, meaning key provisions could still be revised—or removed entirely—before becoming law.

From "Don't Buy Chinese" to "Show Your Work"

For the rare earth industry, the centerpiece is Section 1801, which would substantially rewrite 10 U.S.C. §4872 governing Defense Department procurement of critical materials.

Rather than relying solely on broad sourcing prohibitions, Congress proposes a far more sophisticated framework built around tiered sourcing requirements, phased implementation timelines, domestic content thresholds, contractor certifications, documentation standards, expedited qualification of new suppliers, and structured waiver authorities.

Covered materials extend well beyond permanent magnets to include tantalum, tungsten, gallium, germanium, molybdenum, niobium, and numerous rare earth oxides and metals. More significantly, compliance reaches across virtually the entire value chain—including mining, concentration, refining, separation, reduction, melting, alloying, powder production, sintering, processing, and manufacturing. Under the proposed language, if any of these stages occur within a covered nation, the material may be considered sourced through that jurisdiction.

This represents a meaningful evolution in defense procurement. The question is no longer simply Who sold you the material? Increasingly, it becomes Where did every critical processing step occur?

Paper Compliance May Soon Reach Its Limits

The proposed legislation repeatedly requires contractors to maintain certifications, provenance documentation, supplier records, and supporting evidence for up to ten years across multi-tier supply chains. It also creates a preferred status for qualifying domestic manufacturers while requiring documentation throughout supplier networks. That raises an obvious question.

Can global critical mineral supply chains—still heavily dependent on PDFs, supplier declarations, spreadsheets, and periodic audits—meet these expectations as defense procurement becomes increasingly data-driven?

Rare Earth Exchanges believes this emerging compliance environment creates a significant opportunity for digital provenance technologies.

During the most recent Rare Earth Exchanges Podcast (opens in a new tab), Jacob Clayton, CEO of Sagint, argued that traditional paper documentation simply cannot verify today's globally fragmented critical mineral supply chains. Instead, platforms capable of creating immutable digital chain-of-custody records may become an essential layer of future defense procurement—not because legislation explicitly mandates blockchain or any particular technology, but because increasingly rigorous sourcing requirements may eventually demand far more than static paperwork.

The Pentagon Is Thinking Like an Intelligence Organization

Section 1805 reinforces this broader trend by directing the Department of Defense to establish a department-wide Defense Supply Chain Intelligence and Risk Response Program designed to illuminate, assess, anticipate, and respond to risks across the defense industrial base. Taken together with Section 1801, Congress appears to be signaling that supply chains should no longer be viewed simply as procurement functions. They are becoming strategic intelligence assets that require continuous visibility, risk assessment, and rapid response.

Rare Earth Exchanges View

Whether these provisions ultimately become law remains uncertain. What is becoming increasingly clear, however, is where Congress is headed. The debate is no longer just about rebuilding American mines, refineries, and magnet factories. It is about making sure every strategic material can be tracked, verified, and trusted from the mine all the way to the finished defense component.

The next generation of winners may not consist solely of miners, refiners, metal producers, and magnet manufacturers. Increasingly, they may also include companies developing digital compliance, provenance, and supply-chain intelligence platforms capable of verifying the origin and movement of strategic materials. If the United States is serious about enforcing domestic sourcing requirements, proving where every atom came from could become just as important as producing it.

That raises a series of questions investors should begin asking today:

  • Who will provide the digital infrastructure that verifies critical minerals from mine to magnet?
  • How will defense contractors demonstrate compliance with increasingly complex sourcing requirements?
  • Will paper certificates and supplier declarations satisfy future Pentagon procurement standards, or will continuous digital verification become the norm?
  • Which companies will become the trusted custodians of strategic material provenance?
  • And perhaps most importantly, will tomorrow's competitive advantage come from owning the mine, the processing—or perhaps from owning the trusted data that proves what came out of it?

Those questions may ultimately prove just as important as the location of the next rare earth discovery.
