According to David Madison, writing for Cowboy State Daily last month (opens in a new tab), Ramaco alleges Moyes emailed more than 40 confidential documents—including a Preliminary Economic Assessment (PEA), process flowsheets, financial models, and DOE-related materials—to his personal account before resigning in October 2025. The company claims this occurred while Moyes was already in discussions with USA Rare Earth, raising the stakes from routine departure to potential premeditated misappropriation.

The complaint, filed March 16, 2026, in U.S. District Court (Wyoming), (opens in a new tab) seeks a temporary restraining order, forensic imaging of devices, and damages under federal and state trade secret laws. Ramaco argues the materials reflect millions in R&D tied to its Brook Mine—marketed as the first new U.S. rare earth mine in decades.
